Welcome to HestiaMatch. By accessing or using our mobile application and website (collectively, the "Service"), you agree to be bound by these Terms of Service. Please read them carefully.

Zero Tolerance for Objectionable Content and Abusive Users

HestiaMatch enforces a strict zero-tolerance policy regarding objectionable content and abusive behavior. This includes, but is not limited to: sexually explicit material, hate speech, harassment, threats, discrimination, impersonation, scams, solicitation, and any content that demeans or endangers other users.

When you create an account, you explicitly accept the following commitments:

• You will not post, share, or transmit any objectionable content.
• You will not engage in abusive behavior toward other users.
• You acknowledge that any reported violation will be reviewed within 24 hours.
• Offending content is removed immediately upon confirmation.
• Users found responsible for objectionable content or abusive behavior are ejected from the platform without refund and without prior notice.

Every user has access to in-app reporting and blocking tools on every profile and every conversation. When you block another user, their content is removed from your experience instantly, and the block triggers a moderation review on our side.

1. Acceptance of Terms

By creating an account or using HestiaMatch, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our Service.

2. Eligibility

You must be at least 18 years old to use HestiaMatch. By using the Service, you represent and warrant that you:

• Are at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Are not prohibited from using the Service under applicable laws
• Have not been previously banned from the Service

3. Service Description

HestiaMatch is a dating platform designed to help adults establish meaningful, long-term relationships. Our features include:

• Profile creation and matching
• Messaging between matched users
• Spark Cards for real-life connections
• Matchmaker mode for helping friends and family
• Premium subscription features

4. User Account

You are responsible for:

• Providing accurate and complete information when creating your account
• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

5. User Conduct

You agree not to:

• Provide false or misleading information
• Use the Service for any illegal purpose
• Harass, abuse, or harm other users
• Send spam or unsolicited messages
• Upload content that is offensive, inappropriate, or violates others' rights
• Attempt to access other users' accounts
• Use automated systems or bots to access the Service
• Interfere with the proper functioning of the Service

6. Content

You retain ownership of content you upload to HestiaMatch. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service.

We reserve the right to remove any content that violates these terms or is otherwise objectionable.

7. Matchmaker Mode

HestiaMatch allows users to act as matchmakers for friends and family. When using this feature:

• You must have permission from the person you are helping
• You are responsible for actions taken on their behalf
• The person being helped can revoke matchmaker access at any time

8. Payments and Subscriptions

Certain features require payment:

• Premium Subscriptions: Billed through Apple App Store or Google Play. Subscriptions auto-renew unless cancelled.
• Spark Cards: Physical cards purchased separately and shipped to you.

Refunds are handled according to Apple, Google, or our refund policies as applicable.

9. Sign-in with Apple and Google

You may sign in to HestiaMatch using Sign in with Apple or Sign in with Google. When you do, the provider sends us your email address, first name, and an opaque user identifier. That is the only information we receive from those providers; we do not request or access photos, contacts, posts, or any other content from your Apple or Google account. No other social media integration (TikTok, Instagram, Facebook, Snapchat, etc.) exists in HestiaMatch today.

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Conduct that we determine is harmful to other users or the Service
• Any other reason at our sole discretion

You may delete your account at any time through the app settings.

11. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee:

• That you will find a match or relationship
• The accuracy of information provided by other users
• Uninterrupted or error-free service

12. Limitation of Liability

To the maximum extent permitted by law, HestiaMatch shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the new terms and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance.

14. Service Provider, Governing Law, and Dispute Resolution

14.2 Governing Law

These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the French Republic, without regard to its conflict-of-laws rules.

If you reside in the European Union, the European Economic Area, or the United Kingdom, the mandatory consumer-protection laws of your country of residence continue to apply and are not waived by this clause.

14.3 Court Jurisdiction

Disputes between consumers and HestiaMatch shall be brought, at the consumer's choice, before:

• the competent court of the consumer's place of residence; or
• the Tribunal Judiciaire d'Annecy, France (the court for the Service Provider's registered address).

For users outside the European Union, disputes shall be brought before the Tribunal Judiciaire d'Annecy, without prejudice to mandatory rules of the user's country of residence.

14.4 Pre-Litigation Mediation (EU Consumers)

Before initiating court proceedings, consumers residing in the European Union may use the European Online Dispute Resolution platform made available by the European Commission at https://ec.europa.eu/consumers/odr/, or contact a French consumer mediator (see economie.gouv.fr/mediation-conso).

14.5 In-App Purchases

All HestiaMatch premium subscriptions are sold and delivered by Apple Inc. (through the Apple App Store) or Google LLC (through the Google Play Store), each acting as the merchant of record for purchases made on its respective platform. Refund requests for those purchases are handled directly by Apple or Google under their published refund policies. HestiaMatch does not process subscription payments and does not have access to your payment card details.
